1. Scope
These general terms and conditions apply to all business relationships between Birgit Niehaus GmbH Nordic noble way of life! (birgit-niehaus.de) and its contractual partners as well as all information provided in connection therewith (in letters, publications, price lists, advertisements or in any other way) regardless of the form in which this information was provided.
Conflicting general terms and conditions of contractual partners will not be recognized. Their inclusion in contracts with Birgit Niehaus GmbH is contradicted. Upon conclusion of the contract, these general terms and conditions are accepted by the contractual partners of Birgit Niehaus GmbH.
2. Offer of goods / conclusion of contract
The product offers (brochures, websites, newsletters, etc.) from Birgit Niehaus GmbH are subject to change and non-binding; there is no guarantee that any information is correct or complete. By placing an order in text form or by telephone, the contractual partner makes a binding offer to conclude a contract. Birgit Niehaus GmbH accepts this offer by sending a declaration in text form of acceptance of the offer. If the ordered goods are no longer available, Birgit Niehaus GmbH will inform you immediately.
If the goods are ordered electronically, confirmation of the conclusion of the contract and the general terms and conditions will be saved and sent to the buyer by email. For security reasons, the contract is not stored online.
Buyers can correct their entries before placing an online order by changing the relevant input fields using the mouse or keyboard and correcting previous pages using the browser's back button or by canceling the ordering process and starting again if necessary. After clicking the binding order button, a correction is no longer possible.
When placing an order, the contractual partner is obliged to provide complete and correct information. 3. Prices, terms of payment, delivery, retention of title
All prices quoted are exclusive of the stated costs for packaging and shipping. Delivery dates mentioned are non-binding. All prices mentioned, including packaging and shipping, only apply within Germany.
With updating of the Internet pages under the domainshttps://birgit-niehaus.deall previous prices and other information about goods become invalid. The version valid at the time of the order is relevant.
Unless otherwise agreed, the invoice amount is due upon receipt of the invoice. Default occurs at the latest if payment is not made within 30 calendar days of the due date and receipt of the invoice. The customer is only entitled to set off counterclaims if they have been legally established or recognized by Birgit Niehaus GmbH.
Our items are shipped FREE from the warehouse, Birgit Niehaus GmbH, Dörpstraat 63, 25842 Bargum.
We would be happy to arrange delivery for you via a forwarding company or via UPS, FEDEX and DHL. For shipping costs within Germany, please see the shipping costs for the respective item in our online shop. For shipments outside of Germany, please contact us in advance.
For shipments beyond Germany, no liability is assumed for transport damage.
Self-collection is possible by arrangement.
Birgit Niehaus GmbH reserves ownership of the goods until all of Birgit Niehaus GmbH's claims against the buyer arising from the contract have been settled.
4. RIGHT OF WITHDRAWAL
If the contract is concluded using means of distance communication and this is a distance selling transaction, all consumers have the following statutory right of withdrawal. A consumer is any natural person who concludes a legal transaction for purposes that cannot primarily be attributed to their commercial or independent professional activity (Section 13 BGB).
